#11: Bill NY S1784: Proposed Infection Control Quality Assurance Requirements in ACFs

Bill NY S01784 would require Adult Care Facilities to have quality improvement committees and a focus on infection control in the facility’s quality assurance plan.  The bill has currently passed both houses and will be submitted for signature by the Governor making it effective in the coming months.

In this session the presenter will cover the proposed language of the bill, how it will affect ACFs, potential approaches to meeting these new requirements, and the key components to successful infection control quality assurance.

 #13: Infection Control Practices: Maintaining Compliance with Resident and Staff Support

During the pandemic, infection control training and directives were amplified.   Conflicting and unclear messaging from the regulatory agencies were the norm.  Facilities were challenged daily with educating staff and residents on important practices and messaging effectively to maintain adherence to the standards.   In this session, we will review current guidance, processes and practices to facilitate effective education and maintain the best outcomes including staff and resident compliance.

#14: New York State’s Criminal History Record Check (CHRC) Requirements for Adult Care Facility/Assisted Living Providers

Our presenters from the NYS Department of Health will provide an overview and update on CHRC-related topics including the fingerprinting process, the Department’s legal determination process, commensurate employment determination letters and how the ACF/ALR/ALP provider must procced, how to address subsequent arrests and use of the CHRC system’s tracking and reconciliation reports.

As Associate Attorney, he is responsible for all CHRC legal unit operations and training. He is also responsible for legal support of the NYS Home Care Registry and the Board of Examiners of Nursing Home Administrators. Integral in establishing, creating and updating the DOH criminal history background check program from its inception in 2006.  Mr. Barra graduated from Albany Law School in 1992 where he served as a member of the Albany Law Review. He has been a member of the New York State and Washington, D.C. Bar since 1993.  His career includes private general law practice and federal criminal law enforcement as a Former Special Agent with both the Federal Bureau of Investigation and the Office of the Inspector General, D.C. Government, where he conducted criminal investigations into a wide variety of federal law violations that included organized crime, fugitive investigations, bank fraud and embezzlement matters and other white-collar crimes.

Cunningham, Esq. is an Associate Attorney with the New York State Department of Health Criminal History Record Check Unit (CHRC). Ms. Cunningham graduated magna cum laude from Boston College in 1990 and from New York University School of Law in 1993. She is currently licensed to practice law in both New York and Massachusetts. She came to the Department of Health in 2009 and is an Associate Attorney currently working with staff attorneys in the CHRC unit. She assists the Unit Leader and is responsible for reviewing both the New York State and the national (FBI) criminal histories of unlicensed applicants seeking employment for work in nursing homes and home care. She evaluates the relevancy of any such criminal history as it pertains to the proposed employment, reviews rehabilitation documentation submitted by applicants or their attorneys, and then renders determinations regarding an applicant’s suitability for such employment.
