Termination of Admission Agreements: Legal Solutions to Problem Residents 

We will discuss nuts and bolts legal solutions to problems that administrators encounter from time to time with residents, ranging from those who fail to pay required use and occupancy fees to those who, in various ways, disrupt the orderly operation of the facility, to residents who are no longer appropriate -medically or mentally- for an assisted living residence. Among other things, we will explore the steps that administrators should take to monitor and document problem areas, measures that should be taken in preparation for litigation, and the pitfalls and challenges of litigation. Special attention will be paid to ways in which administrators and legal counsel can work well together to ensure that difficult residents are treated firmly and fairly within the bounds of the law and that all residents and staff are insulated, as well as possible, from disruptions caused by problem residents.

Mr. Reisman has been engaged in the practice of law since 1984. After several years as a partner with the Poughkeepsie, NY law firm of Wolfson, Greller, Reisman & Egitto, followed by seven years as a solo practitioner, he became, in 2007, one of the founding members of Reisman Rubeo & Altman, LLP. Since 2008, the firm has been based in Hawthorne, New York (Westchester County). Mr. Reisman heads the firm’s litigation practice. His areas of focus include, among others, complex commercial litigation and business disputes; employment contracts and contracts litigation; employment discrimination claims; trade secrets and restrictive covenants litigation; disputes involving assisted living and related facilities; and real estate litigation. In addition to practicing before the trial and appellate courts of the State of New York and in various federal district and appellate courts, Mr. Reisman has appeared in courts in other states after being granted pro hac vice admission.
